Welcome to Hyphans. By accessing and using our platform, website, and services (collectively referred to as the “Platform”), you agree to comply with and be bound by the following Terms and Conditions. If you do not agree to these Terms, you must discontinue using the Platform immediately.

  1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of Hyphans, including our websites, mobile applications, APIs, services, tokens (HYPN), and related products. By using the Platform, you confirm that you are at least 18 years of age or the legal age required in your country, and that you have the legal capacity to enter into these Terms.

  1. Definitions

– “We,” “Our,” “Us”: Refers to Hyphans and its affiliated companies.

– “User,” “You”: Refers to any individual or entity that accesses and/or uses the Platform.

– “Services”: Refers to the blockchain-related services, staking, token sales, and other products provided on the Platform.

– “HYPN”: The native ecosystem token issued by Hyphans.

– “Wallet”: A blockchain wallet address registered by the User for accessing Platform services.

  1. Acceptance of Terms

By registering on the Platform, using our services, or participating in the HYPN token sale, you agree to:

– Comply with these Terms and any other legal agreements made between you and Hyphans.

– Be responsible for all actions taken under your account, including the security of your wallet and access credentials.

If you do not agree to these Terms, do not use the Platform.

  1. Modifications to the Terms

We reserve the right to modify, change, or update these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform after any modifications indicates your acceptance of the new Terms. Please review these Terms periodically.

  1. Registration and Account
  2. Eligibility: To use our Services, you must create an account. By registering, you agree that:

   – You are the legal owner of any wallet addresses provided.

   – You are not a resident of any country where blockchain-related activities are restricted or illegal.

   – You will provide accurate and complete information during registration and update your details as necessary.

  1. Account Security: You are responsible for safeguarding your wallet, private keys, and other credentials. Hyphans will not be liable for any loss or damage arising from unauthorized access to your account or wallet due to your failure to secure these credentials.

 

  1. Use of the Platform
  2. Permitted Use: You are granted a limited, non-exclusive, non-transferable, revocable license to use the Platform for your personal, non-commercial purposes. Any use beyond this scope is prohibited.
  3. Prohibited Use: You may not:

   – Engage in any unlawful activities, including money laundering or fraudulent activities.

   – Attempt to hack or exploit vulnerabilities in the Platform.

   – Use automated systems (bots) to interact with the Platform without authorization.

   – Engage in any activity that disrupts or interferes with the proper functioning of the Platform.

   – Participate in any market manipulation, including pump-and-dump schemes or wash trading.

  1. HYPN Token
  2. Nature of Tokens: HYPN tokens are utility tokens for use within the Hyphans ecosystem. They are not financial securities, stocks, or shares in the company.
  3. Token Use: HYPN tokens can be used for accessing services within the Hyphans platform, staking, or as a means of payment for ecosystem-related activities.
  4. Token Purchases: All token purchases are final, and no refunds will be provided, except as required by applicable law. By purchasing HYPN, you acknowledge the inherent risks associated with cryptocurrencies, including but not limited to price volatility and regulatory uncertainty.
  5. Token Lock-up: Certain tokens may be subject to a lock-up period, during which they cannot be transferred, sold, or otherwise disposed of.
  6. Market Risk: You acknowledge that HYPN token value may fluctuate and that past performance does not guarantee future results.
  7. Staking & Rewards
  8. Staking Program: The Platform offers staking services, allowing users to lock their tokens in exchange for potential rewards. These rewards are subject to change based on market conditions and platform performance.
  9. No Guarantees: Hyphans does not guarantee any specific returns or interest rates from staking. Your participation is voluntary and at your own risk.
  10. Compliance with Laws

You agree to comply with all applicable laws and regulations, including but not limited to local laws regarding financial transactions, securities laws, and anti-money laundering (AML) regulations.

  1. AML/KYC Requirements

Verification: Although we operate in a true “decentralized way” but in special cases me may be forced To ensure compliance with anti-money laundering regulations, we may require you to undergo a Know Your Customer (KYC) process in special cases if directed/ordered by the court of law of the country of operations. You must provide truthful and accurate documentation upon request.
  3. Non-Compliance: Hyphans reserves the right to restrict or terminate access to its services if you fail to complete the KYC process or if there are suspicions of illegal activities.
  4. Disclaimer of Warranties
  5. No Warranty: The Platform is provided on an “as is” and “as available” basis without warranties of any kind. We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.
  6. Investment Risks: Hyphans does not provide any investment, financial, legal, or tax advice. You should consult your advisors before making any investment or financial decisions regarding the Platform or tokens.
  7. Limitation of Liability

To the maximum extent permitted by law, Hyphans and its affiliates will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to:

– Your use or inability to use the Platform.

– Unauthorized access to or alteration of your data.

– Any errors or omissions in the Platform’s functionality.

In no event will our total liability exceed the amount paid by you (if any) for using the Platform.

  1. Indemnification

You agree to indemnify, defend, and hold harmless Hyphans, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your use of the Platform, violation of these Terms, or any applicable laws.

  1. Termination
  2. By You: You may terminate your account at any time by discontinuing use of the Platform.
  3. By Hyphans: We reserve the right to suspend or terminate your account and access to the Platform at any time, without notice, for any reason, including but not limited to violation of these Terms.
  4. Decentralized part of the ecosystem like wallets, assets against wallets, smart contracts executions etc can not be terminated at all.
  5. Governing Law

These Terms are governed by and construed in accordance with the laws of [Insert Jurisdiction], without regard to its conflict of law principles. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts in [Insert Location].
